This policy applies to all visitors of our website and registered users of the Service. If you are accessing FluxNote on behalf of an organisation, "you" refers to both you individually and the organisation you represent.

2. Information We Collect

We collect information that you provide directly to us, information we collect automatically when you use the Service, and information from third-party sources.

2.1 Account Information

When you create a FluxNote account, we collect your name, email address, and a hashed password. If you sign up via a third-party OAuth provider (e.g., Google), we receive your name and email address as permitted by your provider's privacy settings. You may optionally provide a profile picture or display name.

2.2 Payment Information

All payment transactions are processed by our third-party payment processors — Razorpay (for Indian customers) and Stripe (for international customers). We do not directly collect, store, or have access to your full credit or debit card numbers, CVV codes, bank account details, or UPI credentials. These processors are PCI-DSS compliant and governed by their own privacy policies. We do receive and store non-sensitive billing metadata such as your subscription plan, billing country, currency, transaction ID, and subscription status to manage your account.

2.3 Usage Data

We collect information about how you interact with the Service, including videos you create, scripts and prompts you enter, features you use (e.g., caption styles, motion effects, stock footage selections), export actions, and the frequency and duration of your sessions. This data helps us understand how users engage with the product and how we can improve it.

2.4 Technical Data

When you access the Service, we automatically collect certain technical information, including your IP address, browser type and version, operating system, device type, screen resolution, referring URLs, and timestamps of your requests. This information is used for security monitoring, debugging, abuse prevention, and service optimisation.

2.5 Cookies and Analytics

We use cookies and similar tracking technologies to operate the Service and understand user behaviour. Specifically, we use:

  • Session cookies — required to keep you logged in during a session.
  • Preference cookies — to remember your settings and preferences.

3. How We Use Your Information

  • To provide and operate the Service. Your account information, usage data, and uploaded content are required to generate videos, store your projects, and serve your dashboard.
  • To improve and develop the Service. Aggregate and anonymised usage data helps us identify bugs, optimise performance, and prioritise new features.
  • To process payments. Billing metadata is used to manage subscriptions, handle failed payments, issue refunds, and maintain accurate financial records as required by law.
  • To send transactional emails. We send account-related communications such as welcome emails, password reset links, subscription confirmations, payment receipts, and important service notices. You cannot opt out of transactional emails while your account is active.
  • To send marketing emails. With your consent (or where permitted by applicable law for existing customers), we may send you newsletters, product updates, and promotional offers. You can opt out at any time by clicking "Unsubscribe" in any marketing email or by emailing support@fluxnote.io.
  • To ensure security and prevent fraud. Technical data and usage patterns are analysed to detect and block suspicious activity, abuse of the API, or violations of our Terms of Service.
  • To comply with legal obligations. We may process your data where required by applicable law, including the Indian Information Technology Act, 2000 and its Rules, and other regulations applicable to our business.

4. How We Share Your Information

We do not sell, rent, or trade your personal information to any third party for their own commercial purposes. We share your information only in the following limited circumstances:

4.1 Payment Processors

When you make a purchase, your billing information is shared directly with Razorpay and/or Stripe as necessary to complete the transaction. These processors operate under their own privacy policies and are independently responsible for the data they receive. We encourage you to review the Razorpay Privacy Policy and Stripe Privacy Policy.

4.2 Cloud Infrastructure Providers

The Service is hosted on cloud infrastructure provided by Amazon Web Services (AWS) and/or Google Cloud Platform (GCP). Your data, including videos and account information, is stored on servers managed by these providers. Both providers maintain robust security certifications and data processing agreements with us.

4.3 Analytics Providers

We share anonymised, aggregated website usage data with Google Analytics to help us understand how users interact with our website. This data does not directly identify individual users.

4.4 Legal Requirements

We may disclose your information if required to do so by law or in response to a valid legal request from a competent authority (such as a court order, government agency, or law enforcement body), provided such disclosure is consistent with applicable law. We will endeavour to notify you of such requests where legally permissible.

4.5 Business Transfers

In the event of a merger, acquisition, restructuring, sale of assets, or similar business transaction, your information may be transferred to the acquiring entity. We will notify you via email or a prominent notice on the Service before your data is subject to a different privacy policy.

We never sell your personal data.

FluxNote does not sell, rent, lease, or otherwise trade your personal information to third parties for money or other consideration.

5. Data Retention

We retain your personal information for as long as your account is active or as needed to provide you with the Service. Specifically:

  • Account data is retained for the duration of your account and for up to 90 days after account deletion, to allow for recovery in case of accidental deletion and to comply with legal obligations.

  • Video projects and generated content are retained while your account is active. Upon account deletion, your videos will be permanently deleted within 30 days unless we are legally required to retain them.

  • Payment and billing records are retained for a minimum of 7 years as required by Indian financial regulations and tax laws.

  • Log and technical data (e.g., IP address logs, server access logs) are retained for up to 12 months for security and debugging purposes, after which they are deleted or anonymised.

  • Analytics data is retained in aggregated, anonymised form indefinitely and in identifiable form for up to 26 months per Google Analytics default settings.

After the applicable retention period, data is securely deleted or anonymised so that it can no longer be associated with you.

6. Your Rights

Depending on your location and applicable law, you may have certain rights regarding your personal data. We honour these rights for all users regardless of jurisdiction.

We may need to verify your identity before processing your request. There is no charge for making a request, though we may charge a reasonable fee for manifestly unfounded or excessive requests.

FluxNote is operated from India, and our servers may be located in various regions including the United States, Europe, and Asia-Pacific, depending on the cloud infrastructure provider's region configuration. By using the Service, you acknowledge and agree that your personal information may be transferred to and stored on servers located outside your country of residence.

For users in the EEA or UK, where we transfer personal data outside the EEA/UK, we ensure adequate safeguards are in place, such as:

  • Standard Contractual Clauses (SCCs) approved by the European Commission.

  • Transfers to countries or processors that have been deemed to provide an adequate level of protection by the European Commission.
